Terms & Conditions

1. Acceptance of terms

By accessing or using MyHome-Me (“the Platform”), operated by Home-Me (Pty) Ltd (Reg No: 2025/22594/07), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Platform.

2. The platform

MyHome-Me is an online marketplace that connects space owners (“Owners”) with individuals or businesses seeking short-term or flexible use of those spaces (“Seekers”). Home-Me (Pty) Ltd is not a party to any rental agreement between Owners and Seekers, and is not responsible for the condition, safety, or legality of any listed space.

3. User accounts

  • You must be at least 18 years old to create an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate and truthful information when registering and listing spaces.
  • We reserve the right to suspend or terminate accounts that violate these terms.

4. Listing rules

Space Owners agree to:

  • Only list spaces they have the legal right to rent out.
  • Ensure the space complies with all applicable zoning, safety, and municipal regulations.
  • Provide accurate descriptions, photos, and pricing.
  • Honour approved bookings unless exceptional circumstances prevent it.
  • Maintain the space in a safe and clean condition for Seekers.

5. Platform commission

MyHome-Me charges a 20% commission on the total value of each confirmed booking. This fee is deducted automatically at the time of payment processing. The remaining 80% is paid to the Space Owner. There are no listing fees or monthly subscription charges.

A 5% service provider fee may apply to net platform profits and is used for operational costs and growth.

6. Payments

All payments are processed through PayFast, a South African payment gateway. By making a payment, you also agree to PayFast's terms of service. MyHome-Me does not store credit card or banking details.

All prices on the Platform are quoted in South African Rand (ZAR) and are inclusive of VAT where applicable.

7. Verification and identity checks

To promote trust, safety, and transparency on the platform, MyHome-Me may require users to complete an identity verification process before accessing certain features or completing bookings.

Verification services are powered by Smile ID, a third-party identity verification provider. By using the platform, you consent to the collection, processing, and verification of your personal information and identification documents through Smile ID for fraud prevention, security, compliance, and user authentication purposes.

Users may be required to provide:

  • A valid government-issued identification document;
  • A selfie or biometric verification image;
  • Contact and address information; and/or
  • Any additional information reasonably required for verification purposes.

MyHome-Me reserves the right to:

  • Approve, decline, or re-request verification information at its discretion;
  • Suspend or restrict accounts where verification cannot be completed successfully;
  • Remove listings or deny bookings where fraudulent, misleading, or suspicious activity is suspected.

All personal information submitted during the verification process will be handled in accordance with applicable data protection laws and MyHome-Me's Privacy Policy. MyHome-Me does not store biometric data unless required for operational or legal purposes.

By continuing to use the platform, you acknowledge and agree to the verification procedures described above.

8. Cancellations and refunds

Cancellation policies are set by individual Owners and are clearly stated on each listing. MyHome-Me is not responsible for enforcing refunds between Owners and Seekers. In the event of a dispute, contact our support team and we will mediate in good faith.

9. Termination

The platform may suspend or terminate accounts at any time and for any reason, including but not limited to:

  • Fraud
  • Non-compliance
  • Violation of these Terms
  • Behaviour deemed harmful to the Platform

10. Prohibited conduct

You may not:

  • Use the Platform for any unlawful purpose.
  • Post false, misleading, or fraudulent listings or reviews.
  • Harass, threaten, or abuse other users.
  • Attempt to circumvent the Platform's payment system (e.g., arranging off-platform payments to avoid commission).
  • Scrape, copy, or redistribute content from the Platform without permission.

11. Limitation of liability

To the maximum extent permitted by South African law, Home-Me (Pty) Ltd shall not be liable for:

  • Any loss or damage to property while using a listed space.
  • Personal injury arising from the use of any listed space.
  • Disputes between Owners and Seekers.
  • Loss of income, data, or business arising from use or inability to use the Platform.

The Platform is provided “as is” without warranties of any kind.

12. Reviews

Reviews must be fair, factual and free from unlawful, defamatory, discriminatory, or abusive language. We reserve the right to remove or refuse reviews at our discretion.

13. Intellectual property

All content, design, and code on the Platform is owned by Home-Me (Pty) Ltd unless otherwise stated. Users retain ownership of the content they upload (listings, photos, messages) but grant MyHome-Me a non-exclusive licence to display that content on the Platform.

14. Indemnify

You agree to fully, indemnify, defend, and hold harmless Home-Me (Pty) Ltd, its directors, employees and affiliates from any claims, losses, damages, liabilities, penalties, legal fees, or expenses arising out of:

  • Your use of the Platform
  • Your use, rental, or occupation of any space
  • Any agreement between you and another space seeker
  • Personal injury, property damage, theft, or loss
  • Violation of these Terms
  • Infringement of any third-party rights
  • Any dispute between you and another space seeker

This indemnity survives the termination of your account and continues indefinitely.

15. Governing law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of South Africa, in the jurisdiction where Home-Me (Pty) Ltd is registered.

16. Changes to these terms

We may update these Terms & Conditions at any time. Material changes will be communicated via email or a notice on the Platform. Continued use after changes take effect constitutes acceptance.
